Terms of Use – VibeFinancy App and Website:
These Terms of Use constitute a binding legal agreement between you and VibeFinancy (hereinafter: the "Operator"), governing your use of the website, the apps, and all related services, content, and products (hereinafter: the "Service" and/or the "Services").
The Service includes apps and/or a financial app for managing a personal budget, expenses, income, debts, loans, and more, as well as a website that includes a variety of financial content, a blog, articles, videos, courses (paid or free), and additional educational tools and materials.
Your use of the Service (on the website or in the apps) constitutes full and unconditional agreement to all terms set out below.
For convenience, this document is written in the masculine form only, but it is intended for all genders. The Service is intended solely for users aged 18 and above.
1. Registration, user account, and access details:
Use of some Services requires registration, including providing personal details and creating a password, including through Google, Facebook, Apple, or direct registration. The user undertakes to:
-Provide accurate, complete, and up-to-date details.
-Keep access credentials confidential.
-Report to the Operator any concern regarding unauthorized use.
The user is responsible for all activity carried out through the account.
The Operator may block or suspend an account in the event of a breach of these Terms of Use.
2. Prohibited user conduct:
The user undertakes not to perform through the Service any unlawful, harmful, or rights-infringing action, including:
-Commercial use of content.
-Impersonation of another person.
-Providing false information.
-Attempting to gain unauthorized access to systems.
-Compromising information security.
-Uploading harmful, threatening, defamatory, or unlawful content.
-Distributing viruses, malicious code, or any means that may impair app functionality.
-Overloading the Operator's servers.
-Any action that may harm the experience of other users.
The Operator may take any legal or technological measure in the event of a violation.
3. No license and limitations regarding financial information:
-No license: The Operator does not hold a portfolio management license, pension license, investment marketing license, tax advisory license, insurance advisory license, or investment advisory license as defined under the Regulation of Investment Advice, Investment Marketing and Portfolio Management Law, 1995.
-User's sole responsibility: Any reliance on information appearing in the Service is at the sole and full responsibility of the user. The Operator, its employees, and anyone on its behalf will not be liable for any damage, loss of profits, or distress caused as a result of financial or economic decisions made following use of the Service. You should conduct your own independent review and consult a duly licensed professional before taking any action.
-Disclosure and objectivity: It is clarified that the Operator (or its affiliates) may have a personal interest in financial assets mentioned in the Service and may trade or act in relation to them from time to time. Mention of any asset does not constitute an objective recommendation and should not be interpreted as indicating investment merit.
4. User content and usage license:
When entering financial data, uploading content including user-generated content (UGC) and comments, or using app or website functions, the user grants the Operator a license:
-To use the information for operating the Service.
-To use the information in a non-identifying manner.
-The user grants the Operator a free, non-exclusive, worldwide, irrevocable license for the duration of copyright to display, reproduce, store, technically edit, quote, make accessible, and distribute the content as part of the Service, its archives, or its promotion (including on social media).
-To generate statistical and research data.
-To use the information in a way that does not identify the user.
The user declares that all uploaded information is owned by the user and does not infringe third-party rights.
The user bears sole responsibility for any link, post, comment, image, or any other content the user publishes.
By publishing content, the user declares that they hold all required rights and that the publication does not infringe copyright, privacy, defamation laws, or any other law.
5. Notice and takedown procedure:
If you believe that certain content infringes rights, you may send a notice to: contact@vibefinancy.com with an exact link, details of the claim, and your contact details. The Operator will review the notice and act within a reasonable time and in good faith.
6. Paid services and purchases:
Some Services may be subject to payment (such as lectures, courses, and premium content). Payment will be made through a secure payment processing system, and the Operator does not store credit card details.
The user is responsible for providing accurate details when making a purchase.
The cancellation policy complies with the Consumer Protection Law, including:
-A right of cancellation within 14 days for transactions that are not excluded by law.
-No right of cancellation for digital content after access has been granted.
-Cancellation fees may apply according to law.
The Operator may cancel a transaction in the event of an error, inability to provide the Service, or suspicion of fraud.
7. Intellectual property:
All intellectual property rights in the Service (code, design, logo, content, blog, courses, videos, articles, and similar materials) belong exclusively to the Operator. It is prohibited to copy, reproduce, distribute, create derivative works, or make commercial use without prior written approval.
8. External links:
The Services include links to external websites. The Operator is not responsible for the content, security, or availability of external websites linked from the Service.
Use of Services that include external websites is at the user's sole responsibility.
9. Artificial intelligence (AI) features and generated content:
Some of our Service features are powered by external artificial intelligence providers (hereinafter: "AI Services"), such as, for example, OpenAI, Apple, Anthropic, xAI, Google, and others. When you use these features, your inputs (prompts), conversation history, and generated outputs are processed by those external AI providers.
Ownership and use of content:
-You retain ownership of the content you input.
-You own the AI-generated output, subject to the terms of the relevant provider and provided that you comply with those terms.
-However, outputs may be similar or identical to content generated for other users. We do not guarantee that any output is unique, accurate, complete, or free of errors, bias, or harmful content.
User responsibility: You are solely responsible for:
-All content you input into AI features.
-Reviewing, verifying, and validating any AI-generated output before using or relying on it.
-Ensuring that your use of AI features and outputs complies with applicable law, these terms, and does not infringe third-party rights (including copyright).
Clarifications and limitations:
AI-generated content is provided "as is" and "as available" without warranties of any kind. We make no commitment regarding the accuracy, reliability, safety, or suitability of any AI output. We are not responsible for decisions, actions, or damages resulting from reliance on AI-generated content.
We reserve the right to monitor, filter, or block inputs or outputs that violate our policies or the policies of the AI providers.
Compliance with third-party terms:
Your use of AI features is also subject to the terms of use and acceptable use policies of our AI providers. By using the Service, you agree to comply with those terms. Those terms are also part of the privacy policy.
By using an AI-based feature, you acknowledge and accept the risks associated with generative AI technology.
10. Information security:
The Operator implements customary security measures to protect user information. However, absolute protection against breaches, failures, or unauthorized access cannot be guaranteed.
The user waives any claim arising from events beyond the Operator's control.
11. Limitation of liability and indemnification:
The Service is provided on an "As Is" basis. The Operator does not guarantee continuous availability of the Service, error-free operation, data and calculation accuracy, complete accuracy, perfect suitability to personal needs, or any financial outcome.
The Operator may at any time, without prior notice, modify, disable, remove, or discontinue any part of the Service, content, or tools.
Subject to applicable law, the Operator shall not be liable for any direct, indirect, consequential, incidental, or other damage (including financial loss, loss of profit, loss of opportunity, distress, or any other damage) resulting from use of the Service, reliance on its content, technical malfunctions, changes, or discontinuation of the Service.
The user undertakes to indemnify, defend, and hold harmless the Operator (including its employees, directors, and partners) from any damage, claim, demand, or expense (including attorneys' fees) arising from a breach of these Terms of Use, publication of user content, or unlawful use of the Service.
12. Backups and data restoration:
The user bears sole responsibility for backing up the data entered into the Service. The Operator does not undertake to retain backup copies beyond what is required for operating the Service and will not be liable for any data loss.
13. Termination:
The Operator may terminate use of the Services, block access, or delete an account in any of the following cases:
-Breach of these Terms of Use.
-Unlawful use.
-Harm to the Operator's systems.
-Suspicion of fraud.
The user may stop using the Service at any time.
14. Mailing and marketing:
Registration for the Service constitutes consent to receive:
-Updates.
-Marketing messages.
-Advertisements.
-Professional information.
You may unsubscribe from the mailing list at any time.
15. Changes to the Terms of Use:
The Operator may change these Terms of Use at any time. The updated version will be published in the Services, and continued use after publication constitutes consent to the updated terms. If you do not agree to the changes, you must stop using the Service immediately.
